Transfer of Water Quality Inspectors to DOE NIEA

I am writing to update you following my circular of 10 November 2009.

There has been no progress made with regard to the work needed to take forward consideration of all of the transfer issues.

The Local Government Employers have produced some aspects of the terms and conditions matrix, these will be considered by the Joint Working Group when it meets. As the basis of the transfer would be TUPE the matrix in itself is somewhat academic, the real issue remains that of the Pension Scheme. I regret to advise that nothing further has developed on that front.

A major consideration that has arisen is the impact of Minister Wilson’s 2010/11 spending cuts and you should have seen the January circular from NIEA that touches upon the funding regime. NIPSA has sought a meeting of the Working Group to draw together the various interlinking issues, these include:-

  • Completion of Matrix of terms & conditions;
  • Pensions Report/Assessment;
  • Impact of the 2010/11 cuts announcement;
  • Potential implications post General Election consideration of the Comprehensive Spending Review for the period 2011-2014; and
  • The proposed transfer timeline.

In respect of the latter point the indications are that this has moved to September 2010, however this has not been formally advised to NIPSA.

A further factor that needs to be considered is a NIEA wide assessment – ‘Review of Strategy, Structure and Reform’, which inter alia will take account of the proposed transfer of local government field staff into the NIEA.

I will arrange to issue a further circular post the meeting of the Working Group, which I have sought.
